Owner-Builder Permit for a Granny Flat: NSW Rules and What Other States Expect

An owner builder permit granny flat job in NSW is the paper that lets you supervise (or do) residential building work over $10,000 on your own secondary dwelling, instead of hiring a licensed builder to run the site. It is not a shortcut around CDC or DA, and it does not let you wire or plumb the unit yourself.

NSW: when the permit is actually required

NSW Fair Trading’s page on when an owner-builder permit is needed is the primary. You need one where the reasonable market cost of labour and materials (including GST) exceeds $10,000, the work is a single dwelling, dual occupancy (special circumstances only) or a secondary dwelling, and it has DA or CDC approval.

You also have to intend to live in the house or in one of the dwellings after the work. That trips people who want a pure investment granny flat with no owner occupancy. Fair Trading will not treat a rented backyard box the same as “I’m building my home”.

  • Work over $10,000 (labour plus materials, including GST)
  • Secondary dwelling with CDC or DA already approved
  • You intend to live in a dwelling on the lot after the work
  • White card, and extra training if the job is over $20,000

You apply through Service NSW with proof of ownership, the approved CDC or DA (not just an application number), a white card, and extra training if the work is over $20,000. All owners go on the application. A permit on this land can block another owner-builder permit on different land for five years.

What the permit does not let you skip

Working as an owner-builder still means you appoint a principal certifier, use licensed trades for electrical, plumbing and other restricted work, and carry the site like a builder would. Kit suppliers who say “owner-builder friendly” are talking about the frame, not a licence to DIY the switchboard.

If you sell within 7 years and 6 months of the permit date, the sale contract needs the consumer warning that an owner-builder permit was issued. That is a disclosure issue, not a trivia line in a listing.

Other states in plain terms

Victoria uses owner-builder registration through the Victorian Building Authority when you take on building work above the state’s threshold. Queensland owner-builders deal with the QBCC, not Fair Trading. WA, SA and Tasmania each have their own owner-builder or owner-builder-equivalent settings. Don’t photocopy a NSW permit onto a Gold Coast lot.

The constant across states: restricted trades stay licensed. A steel kit with a nice manual does not make you an electrician. Verify whoever you do hire with builder licence checks if you later switch to a contracted builder for lock-up or fit-out.

Kit vs custom: the permit still sits on you

Owner-builder plus kit is a common cost path. The crate is still only a shell unless the supplier’s inclusions say otherwise. Custom builders sometimes still want you as owner-builder on paper so they can work as a contractor under your permit. Read that contract twice. If they are effectively running the job, you may be wearing builder risk without builder insurance. That is a reason to get a solicitor to read the contract, not a reason to skip the permit.

What design choices affect approval speed?

Setbacks, height, floor area and tree protection overlays decide whether you stay on a fast CDC track or drop to a slower DA. Staying under common 60 sqm internal caps, keeping adequate side and rear setbacks and connecting services without major easement conflicts usually keeps the pathway simpler. If your block is sloped, flood-affected or heritage-listed, expect extra reports before council or your certifier can sign off.
